Terms & Conditions

Please read these terms carefully before placing an order. They set out the contract between you and us when you buy from gadgetly.co.uk. Nothing in these terms affects your statutory rights as a consumer under UK law.

1. Who we are

Gadgetly is a trading name of Mad Tech Heads Ltd, a company registered in England and Wales under company number 14440918.

We are not currently VAT registered; prices are final and no VAT is added at checkout.

2. Application of these terms

These terms apply to every contract for the sale of goods between you and us through gadgetly.co.uk. By placing an order you confirm that you accept these terms. We may amend them from time to time (see section 18); the version in force when you place your order is the one that applies to that order.

These terms comply with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Consumer Rights Act 2015, the Electronic Commerce (EC Directive) Regulations 2002, and the Sale of Goods Act 1979 where applicable.

The language of the contract is English.

3. Eligibility

To place an order you must be at least 18 years old and legally capable of entering into a binding contract. By ordering, you confirm this is the case.

4. How to place an order

You can place an order by following these steps:

  1. Browse our products and add items to your basket.
  2. Review your basket and click “Checkout”.
  3. Enter your delivery details and choose a payment method.
  4. Review your order summary, including totals and delivery, on the checkout page.
  5. Confirm and submit your order, at which point payment is taken.

You can correct input errors at any point before clicking the final “Pay” button by editing your basket or using your browser’s back button. After payment, if you spot a mistake (such as the wrong address), email info@gadgetly.co.uk as soon as possible so we can amend or cancel the order before dispatch.

5. Contract formation

Your order is an offer to buy from us. After payment we will send an acknowledgement email confirming we have received your order — this is not acceptance. A binding contract is formed only when we dispatch your goods and send a dispatch notification. We may decline any order (for example, if an item is out of stock or we identify a pricing error — see section 7); in that case we will refund any payment in full.

We do not file a copy of the contract that is accessible to you directly; we will keep our own records. We recommend you save or print your acknowledgement email for your records.

6. Prices

All prices are shown in pounds sterling (GBP), are inclusive of any applicable taxes, and are the price you pay at checkout. Delivery within the United Kingdom is free — see our Delivery page.

7. Pricing and description errors

We try hard to make sure prices and product descriptions on the website are accurate, but errors occasionally occur. If we discover an obvious pricing or description error after you place an order but before we accept it (see section 5), we will contact you to either confirm the correct price before proceeding or cancel the order with a full refund. We are not obliged to supply goods at an incorrect price that a reasonable person would recognise as a mistake.

8. Payment

We accept payment by debit and credit card (Visa, Mastercard, American Express) through Stripe, and by PayPal. Payment is taken at the point of order. We do not see, handle or store your full card details — these are processed directly by our payment provider over an encrypted connection.

9. Delivery

We deliver to addresses within the United Kingdom only. Orders are dispatched within 1–2 working days, with delivery usually arriving 2–5 working days after dispatch (up to 7 working days in total). Full delivery information is on our Delivery page.

Passing of risk and ownership: goods are your responsibility (risk passes to you) from the moment they are delivered to the address you gave us. Ownership of the goods passes to you once we have received payment in full and the goods have been delivered.

10. Your right to cancel (14-day cooling-off period)

Under the Consumer Contracts Regulations 2013 you have the right to cancel your order within 14 days of receiving your goods, without giving any reason. Full details, including how to return, who pays postage, and when we refund, are in our Refund & Returns Policy.

To cancel, email us a clear statement at info@gadgetly.co.uk with your order number. You may use the model cancellation form below but it is not obligatory.

11. Faulty, damaged or incorrect goods

Under the Consumer Rights Act 2015 goods must be of satisfactory quality, fit for purpose and as described. If they are not:

  • Within 30 days of delivery: you are entitled to reject the goods and receive a full refund.
  • Within 6 months: you are entitled to a repair or replacement. If that is not possible, or the repair/replacement fails, you are entitled to a refund (which may be reduced for reasonable use).

12. Events outside our control (force majeure)

We are not liable for any delay or failure to perform our obligations under these terms where that delay or failure is caused by events outside our reasonable control, including but not limited to acts of God, extreme weather, strikes, failure of public or private telecommunications networks, carrier delays, fire, flood, pandemic or government action. Your statutory rights remain unaffected.

13. Our liability to you

Nothing in these terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • any other liability that cannot be limited or excluded by law — in particular, your rights under the Consumer Rights Act 2015.

Subject to the above, our total liability to you for any loss or damage arising under or in connection with a contract for the sale of goods is limited to the price you paid for the goods to which that claim relates. We are not liable for any loss that was not foreseeable when you placed your order, or for any business or commercial loss (you are buying as a consumer).

14. Our website and content

All content on gadgetly.co.uk — including text, images, logos, trade marks, design and code — is owned by Mad Tech Heads Ltd or licensed to us, and is protected by UK and international copyright and trade mark law. You may browse the site and print or download extracts for your own non-commercial use. You may not reproduce, republish, scrape, data-mine, resell or otherwise exploit any part of the site without our prior written permission.

15. Acceptable use

When using our website you agree not to: attempt to gain unauthorised access to any part of the site or any server; interfere with, disrupt or place excessive load on the site; submit fraudulent payment details or chargebacks; or use the site for any unlawful purpose.

16. Privacy and cookies

We handle your personal data in accordance with our Privacy Policy and the UK GDPR. For information about the cookies we use see our Cookie Policy.

17. Complaints and dispute resolution

If you have a complaint, please email info@gadgetly.co.uk quoting your order number. We will acknowledge your complaint within 1 working day and aim to resolve it within 10 working days.

If we cannot resolve the matter between us, you have the right to seek free and impartial advice from the Citizens Advice consumer service. We are not currently a member of a certified Alternative Dispute Resolution (ADR) scheme, but you remain free to bring a claim through the courts.

18. Changes to these terms

We may update these terms from time to time. The current version, and the date it was last updated, is always shown at the top of this page. Changes apply only to orders placed after the update date; orders already placed are governed by the version in force when you placed them.

19. Severability and assignment

If any part of these terms is found to be unlawful or unenforceable, the remaining parts continue in full force and effect. You may not transfer any of your rights or obligations under a contract with us without our prior written consent. We may transfer our rights and obligations to another company provided this does not reduce the protections you have under these terms.

20. Governing law and jurisdiction

These terms and any contract between us are governed by the laws of England and Wales. You may bring a claim in the courts of any part of the United Kingdom where you live; we may only bring a claim in the courts of England and Wales.
